Texas Attorney General Ken Paxton sued OpenAI Global, LLC and affiliated entities, including CEO Sam Altman, alleging the company failed to protect Texans from harms of its ChatGPT chatbot while marketing it as safe and reliable.
The lawsuit, filed under the Texas Deceptive Trade Practices—Consumer Protection Act, alleges that OpenAI lacked adequate safeguards and failed to warn users of risks. Large language models can produce inaccurate or harmful information, according to the complaint.
Paxton alleged the platform has caused multiple harms, including aiding mass shooters, encouraging vulnerable people toward suicide, and facilitating minors' addiction to a tool that collects user data without parental oversight.
"With the rapid advancement of AI technology, OpenAI has the responsibility to protect users and warn them of the many dangers of its platform," Paxton said.
