Texas Attorney General Ken Paxton secured an agreement with Lululemon USA requiring the company to maintain strict chemical safety standards across its supply chain.
The settlement stems from an investigation launched in April to determine whether Lululemon misled consumers about potential health impacts of its products, particularly regarding per- and polyfluoroalkyl substances (PFAS), commonly known as "forever chemicals." The synthetic materials commonly used in Lululemon's products have raised health concerns due to their potential association with cancer, infertility, and other serious conditions.
Under the three-year agreement, Lululemon must require vendors to demonstrate compliance with its Restricted Substances List through independent laboratory testing or third-party certifications. The company must verify the validity of certifications and require additional testing when certifications expire, and must take corrective action to address vendor noncompliance.
Attorney General Paxton's office is also investigating other clothing brands, including Hanes and Fruit of the Loom, as part of a broader effort to ensure children's clothing is free from harmful chemicals.
