California Attorney General Rob Bonta concluded there is insufficient evidence to prosecute Los Angeles County Sheriff's Department deputies in the fatal shooting of Martin Sebastian on March 16, 2024. According to Bonta's investigation report, the man had pointed what officers believed was a firearm directly at the deputies outside El Tio Tono Market in Los Angeles; the weapon was later found to be a replica.
After investigating the incident, Bonta's office determined the evidence does not show, beyond a reasonable doubt, that the deputies acted without intent to defend themselves and others from what they reasonably believed to be imminent death or serious bodily injury. Therefore, no criminal charges will be filed.
The investigation identified three recommendations for the Los Angeles County Sheriff's Department. The agency should amend its body worn camera policy and provide additional training on camera activation and post-shooting debriefs. LASD should also provide further training to ensure deputies understand and comply with policies on sequestration to preserve investigation integrity. The department should amend its policy and provide additional training on evidence preservation related to deputy-involved shootings.
The investigation was conducted under Assembly Bill 1506, which requires the state Attorney General to investigate all officer-involved shootings resulting in the death of an unarmed civilian.
