ICE arrests man released by Fairfax County despite child sex charges

Suspect had been arrested on serious charges before county officials released him without notifying immigration authorities.

U.S. Immigration and Customs Enforcement arrested Oscar Evaristo Nunez, an illegal immigrant from Honduras, on Sept. 15 during a targeted enforcement operation in the Washington, D.C. area, according to the Department of Homeland Security.

Nunez had been arrested by local authorities on Aug. 27 and faced charges including aggravated sexual battery, nonconsent filming of a minor, and aggravated sexual battery of a victim under 13. ICE lodged an immigration detainer with the Fairfax County Adult Detention Center on Aug. 29. However, the county released Nunez without honoring the detainer and without notifying ICE, according to DHS.

DHS said Nunez illegally entered the United States near Arizona in or around September 2003. He remains in ICE custody pending immigration proceedings.
